TagTag is a Chrome browser extension that provides bookmark management features, including:

• Bookmark organization and categorization
• Cloud synchronization across devices
• AI-powered bookmark summaries and tagging
• Duplicate detection and cleanup
• Search and analytics features

3. User Accounts

Account Creation: To use cloud features, you must sign in with a Google account. You are responsible for maintaining the security of your account credentials.

Account Responsibilities: You are responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

Account Termination: We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activities.

4. Acceptable Use

You agree NOT to:

• Use the Service for any illegal purposes or in violation of any laws
• Attempt to gain unauthorized access to our systems or networks
• Interfere with or disrupt the Service or servers
• Use the Service to store, share, or distribute malicious content
• Reverse engineer, decompile, or disassemble the Service
• Remove, circumvent, or disable any security features or protections
• Use automated systems to access the Service without permission

5. Data and Privacy

Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and protect your data.

Your Content: You retain ownership of your bookmarks and data. By using the Service, you grant us permission to process, store, and sync your data as necessary to provide the Service.

Backups: While we make efforts to back up data, you are responsible for maintaining your own backups. We recommend regularly exporting your bookmarks.

6. Third-Party Services

The Service integrates with third-party services including Google OAuth, OpenAI, Supabase, and Cloudflare. Your use of these integrated services is subject to their respective terms of service and privacy policies.

7. Intellectual Property

Our Rights: The Service, including all software, designs, graphics, and content (excluding user-generated content), is owned by TagTag and protected by intellectual property laws.

License: We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

8. Service Availability

Uptime: We strive to maintain high availability but do not guarantee uninterrupted access to the Service. The Service may be unavailable due to maintenance, updates, or unforeseen technical issues.

Modifications: We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice.

9. Fees and Payment

The Service is currently provided free of charge. We reserve the right to introduce paid features or subscriptions in the future. Any such changes will be communicated to users in advance.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• Results obtained from the Service will be accurate or reliable
• Any errors in the Service will be corrected

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAGTAG SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claims arising from or relating to the Service shall not exceed $100 USD.

12. Indemnification

You agree to indemnify, defend, and hold harmless TagTag, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your use of the Service or violation of these Terms.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, by providing additional notice (such as an in-app notification).

Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which TagTag operates, without regard to its conflict of law provisions.

15. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
